GREEN CARD FOR PARENTS

There are 2 different paths,  based on whether your parents are in the US or abroad

Your Parents are in the US

The petitioner child  must be a U.S. citizen and over the age of 21

Parents must be physically present in the U.S. and eligible for adjustment of status.

The sponsoring U.S. citizen child files Form I-130 on behalf of their parents. This establishes the parent-child relationship.

USCIS reviews Form I-130. Once approved, the parents can proceed with adjustment of status.

The sponsoring child files Form I-485 to adjust their parents’ status to that of permanent residents. This form includes biographic information, supporting documents, and required fees.

Both parents attend a biometrics appointment for fingerprinting and background checks.

USCIS may schedule an interview to verify the legitimacy of the parent-child relationship and assess eligibility for a Green Card.

 

Your Parents Reside Abroad

After approval of the I-130 USCIS, the case is forwarded to the National Visa Center (NVC).

The NVC processes the case, assigns a case number, and requests fees and supporting documentation.

The sponsoring petitioner child pays required fees and submits the required  documents, including the Affidavit of Support and supporting financial evidence.

Once NVC processing is complete, the case is forwarded to the U.S. embassy or consulate in the parents’ home country.

The parents undergo a medical examination by an approved panel physician to meet health requirements.

The U.S. embassy or consulate schedules a visa interview for the parents. Both parents must attend the interview.

A consular officer conducts an interview to assess eligibility. Parents should bring supporting documents and be prepared to discuss their relationship with the sponsoring child.

If approved, the parents receive an immigrant visa stamp in their passport, allowing them to travel to the United States. If denied, the consular officer provides reasons for the denial.
